Rules and Release of Liability and Cancellation Policy
GENERAL:Use of Pavitt Health and Fitness Center is for current members only. Allowing non-authorized persons to use your key or to train with you will be prosecuted as theft of services.
No drugs or alcohol are allowed on the premises. Members may not train or be on the premises while under the influence of drugs or alcohol. Members agree not to use anabolic steroids.
WET ROOM:The wet room is only open during hours that the gym is staffed. Members must shower off before using the pool, hot tub, or sauna. You must also shower off going from sauna into the hot tub or cold pool.
CHILDREN:Children under 10 years of age are not allowed on any equipment at any time. Children ages 10-14 may train only under direct adult supervision and must also be directly supervised while in the wet room. On their 19th birthday, children will no longer qualify to be joined with their parents on a family membership. If they choose to keep their membership, they will need to sign a new contract as an individual.
EFT:EFT (electronic fund transfer) contracts are open-ended at the end of the commitment period. If notice is not given, funds will continue to be transferred. Until you cancel your membership, you are responsible for all payments, regardless of gym usage. A $20.00 decline fee will be added to each month that we are unable to receive funds via EFT.
CANCELLATION:There is no cancellation fee for Month-to-Month EFT memberships, but you must give a minimum of 15 DAYS NOTICE. No refund will be granted for dues incurred before Pavitt Health & Fitness was notified.
If by reason of death or permanent disability, the buyer is unable to continue the membership, buyer or buyers estate shall be relieved from the obligation of this contract, and if buyer has prepaid any sum, that amount shall be promptly refunded. No refund will be granted for dues incurred before Pavitt Health & Fitness was notified of the disability.
Prepaid memberships are non-refundable and non-transferable.
Should you default on any payment obligation as called for in this agreement, the entire remaining balance shall be deemed due and payable upon demand, and you agree to pay allowable interest, and all costs of collection, including, but not limited to, collection agency fees, court costs, and attorneys’ fees.
WAIVER AND RELEASE OF LIABILITY: The fitness center urges all members to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise class. All exercises, including the use of weights and use of any and all machinery, equipment, and apparatus designed for exercising shall be at the member’s sole risk. Member understands that the agreement to use, or selection of exercise programs, methods, and types of equipment shall be the member’s entire responsibility, and the Club shall not be liable to member for any claims, demands, injuries, damages, or actions arising due to injury to member’s person or property arising out of or in connection with the use by member of the services, facilities, and premises of the Club. Member hereby holds the Club, its officers, owners, agents, and employees harmless from all claims which may be brought against them by member on member’s behalf for any such injuries or claims.
